DATE : 22.12.2021 PER COURT :- This Court while suspending the substantive sentence and releasing the applicant on bail by the order dated 16.02.2017 in Criminal Application No.866 of 2017, has imposed following condition :- '' Pending disposal of the appeal, the applicant shall attend Police Sation Kallam, District Osmanabad, on last day of each month in between 10:00 to 11:00 AM.''

By this application prayer is made to relax the aforesaid condition.

The applicant is convicted for the ofence punishable under Section 363 of the Indian Penal code and is sentenced to sufer rigorous imprisonment for three years.

The learned A.P.P has not disputed the fact that the applicant has attended the concerned police station as directed by this Court.

The learned counsel for the applicant submits that the applicant is an agricultural labour. It is submitted that applicant is not likely to abscond. It is submitted that the applicant has attended the police station for four years.

Considering the fact that the applicant has attended the concerned police station for last four years, the condition imposed by this Court by the order dated 16.02.2017 is relaxed. The application is disposed of.
