We have considered the submissions of the learned Advocates for the respective sides and the learned A.G.P. 2.
Since the matters in which identical fact situation was brought before the Court, are decided by the judgment dated 19/09/2022, delivered by a Co-ordinate Bench of this Court in Writ Petition No.2330/2021 (Upendra Madhavrao Kulkarni Vs.
12212.22wp etc (2) State of Maharashtra and others) and a group of petitions, we requested the learned Advocate Shri. A. G. Vasmatkar, appearing for the Company, to assist the Court, since he had appeared in all these matters, which were decided vide the said judgment. 3.
After granting a pass over, the learned Advocate Shri. Vasmatkar, submits on instructions that, these petitions can be disposed off in the light of the judgment dated 19/09/2022, and the Company would resort to the exercise of verification, as is directed by this Court in paragraph No.10 of the said judgment. 4.
In view of the above, both these petitions are disposed off, for the reasons set out in the judgment dated 19/09/2022. The cases of each of these petitioners would be verified and those petitioners, who are found to be eligible for grant of such financial upgradation, the consequential benefits would be extended to them within a period of four months from today. To make it clear, the exercise of verifying each case of these petitioners and the grant of consequential benefits, if held eligible, would be completed, on or before 31/05/2023.
