Heard the learned Advocate for the Applicant. 2.

Inspite of service, none appears for the Respondent. 3.

This application is filed at the instance of applicant-wife seeking transfer of proceeding of HMP No.49 of 2024 pending in the Court of learned Civil Judge, Senior Division, Latur to the Court of learned Civil Judge, Senior Division, Ambajogai.

The case of the applicant-wife is that she is presently residing at Bardapur Tal. Ambajogai. There are two minor kids less than four years of age, who are staying with the wife. The applicant-wife lost her father

( 2 ) long back and there is no one to accompany her to attend the proceeding at Latur. She thus prays for allowing the application by transferring the proceeding.

The learned Advocate for the respondent submits that this is a fit case where convenience of the wife is required to be seen. There is one proceeding filed under the domestic violence Act in the Court at Ambajogai where the husband is required to attend the proceeding. It is therefore in the interest of justice to allow the application. 6.

Considering above, this application stands allowed in terms of prayer clause (C).

After the proceeding is transferred, the applicant-wife shall cooperate in speedy disposal of the proceedings without seeking unnecessary adjournments. If the Court finds that unnecessary adjournments are sought by the applicant-wife, the Court shall deal with it to compensate the respondent whenever he appears personally in the Court.

The learned Judge shall try to dispose of the proceeding as early as possible and preferably within eighteen (18) months from the date of

( 3 ) transfer of the proceeding.

With this, application stands disposed of.
