Learned counsel for the applicant submits that, the applicant has sustained permanent disablement in the accident to the extent of 50% and he has incurred huge medical expenses. Thus, due to financial constraints the appeal could not be preferred within limitation. 2.
Learned counsel appearing for respondent no.1 insurer has strongly resisted the application.

In view of the submissions above and for the reasons stated in the application, delay of 396 days caused in filing the appeal is hereby condoned. Civil application is allowed and accordingly disposed of.

In appeal, issue notice to the respondents, returnable on 13.4.2017. Learned counsel waives notice for respondent no.1.
