We had issued notice to the nonapplicants. The non-applicants are served. Thereafter, we had issued notice of final disposal to respondent nos.4 and 5. The notice of final disposal is served on respondent nos.4 and 5, still none appears for them.

Mr. Choudhary, learned counsel for review applicant submits that the applicant is not seeking promotion under the provisions of Maharashtra Zilla Parishad Act but is seeking promotion in the State cadre.

If the promotion is sought in the State cadre, then the applicant would have remedy before the Maharashtra Administrative Tribunal.

In light of that, we clarify our order dated 16.09.2019 and observe that if the promotion is not sought under the provision of the Maharashtra Zilla Parishad Act and is sought in the State Cadre, then the applicant also may have remedy before the Maharashtra Administrative Tribunal, as may be permissible in law. The applicant may avail any such remedy available. 5.

Review Application is disposed of.
