1] Heard the learned counsel for the petitioner. 2] The petitioners are the original defendants and the petitioners have filed application for correction / amendment in the written statement. By order dated 12.09.2025, the Joint Civil Judge Junior Division, Renapur, has rejected the said application. The trial Court has observed that the plaintiff has closed evidence on 18.09.2014. Directions are given by the High Court in Writ Petition No.1711 of 2024 that the suit filed by the plaintiff be decided on or before 30.06.2026. There is absolutely no
14594.25WP due diligence at the instance of the defendants. The suit is filed in the year 2011 and the defendants have filed their written statements in the year 2011. The correction relates to the plaint being not signed and verified and the plaint being vexatious and compensatory cost be given of Rs.25,000/-. Considering the gross delay, the trial Court has rightly rejected the application of the petitioners. As such, I do not see any error in the impugned order passed by the trial Court. Hence, the present Writ Petition is dismissed. However, the petitioners are at liberty to raise legal grounds as additionally raised before the trial Court to the extent available in law, at the stage of final hearing. [ARUN R. PEDNEKER] JUDGE DDC
