By this application filed under Section 407 of Cr.P.C., applicant has sought transfer of proceeding of Domestic Violence Application No.206/2021, filed by the respondent in the Court of learned Judicial Magistrate First Class, Ulhasnagar, District Thane, to the Court of learned Judicial Magistrate First Class, Sangamner, District Ahmednagar.

Heard learned advocate for applicant and learned advocate for respondent.

Learned advocate for respondent, on instructions, submits that the proceeding pending before learned Judicial Magistrate First Class, Ulhasnagar, is withdrawn by the respondent on 17/01/2023. In support of his submission, he has placed on record copy of the case details sheet downloaded from the website SVH

2 943-CrA-3098-21.odt of the said Court. It shows that on 17/01/2023, the case filed by respondent is disposed of as withdrawn. In this view of the matter, nothing survives in the matter.

Application is, therefore, disposed of as infructuous. 5.

Fees of the learned advocate appointed for respondent is quantified at Rs.2,500/-. High Court Legal Services, SubCommittee, Aurangabad, to pay the same within a period of four weeks.
