This is an application for cancellation of anticipatory bail granted by the learned Additional Sessions Judge - 3, Nanded.

Learned counsel for the applicant upon instructions from his client wish to withdraw the present Criminal Application with liberty to file the application afresh.

Liberty is granted in view of the statement made by the learned counsel for the applicant, that 3 - 4 petitions are already filed before the Division Bench of this Court including the Writ Petition filed by present respondent No. 2 for quashment of the F.I.R. In the said Writ Petition, the Division Bench of this Court has already stayed the investigation and, therefore, the learned counsel for the applicant wish to withdraw the present Criminal Application with liberty to file application afresh after the disposal of the said Writ Petition by the Division Bench.

The present Criminal application is dismissed as withdrawn with the liberty as prayed for.
