DATE: 9th August, 2018 PER COURT:- When the present matter is taken up for hearing, the learned Counsel appearing for the respondents tendered across the bar the certified copy of the execution proceeding in Special Regular Darkhast No.436 of 2017. The learned Counsel submitted that the parties to the present Second Appeal have settled the dispute amicably in the execution proceeding. The learned Counsel invited my attention to the order passed by the Executing Court on 09.07.2018.

Learned Counsel for the appellants submits that he has also instructions from instructing lawyer from the District Court

{2} 7 SA 1 of 2018 that the dispute between the parties is amicably settled. The document tendered across the bar by the learned Counsel Shri V.D.Gunale is taken on record.

In view of the fact that the dispute between the parties is amicably settled in the execution proceeding, there appears no propriety in keeping the present Second Appeal pending. The present Second Appeal therefore, stands disposed of. Pending Civil Application is also disposed of. (P.R.BORA) JUDGE SPT
