After hearing learned counsel for the petitioner for some time and when this Court has shown its disinclination to cause interference in the impugned order, learned counsel for the petitioner, on instructions, seeks withdrawal of the petition. He, however, seeks observations that the findings recorded by the Trial Court and confirmed by the District Court being on prima facie consideration of record, the same shall not come in way of the plaintiff at the time of decision of the suit. Hence, petition stands dismissed as withdrawn with clarification that the prima facie observations made by the Trial Court shall not come in way of the plaintiff in the trial of the suit .
