Heard.

The petitioner/trust is seeking the registration of its Child Care Home under Section 41 of the Juvenile Justice (Care and Protection of Children) Act, 2015. It was having the registration under the predecessor Act of 2000. The learned Advocate for the petitioner submits that its application is pending with the respondents/authorities since 2018 and is not being considered. He submits that in several similar matters, this Court has issued directions to the authorities to consider the request on own merits and the petitioner is seeking the same relief.

In the matter of Mother Teresa Balakashram Vs. State of Maharashtra and Others in Writ Petition No.7821/2021, this Court has given elaborate instructions as to the manner in which the authorities should approach the issue.

We dispose of the writ petition by directing the respondents to take appropriate decision on the petitioner's application on its own merits but as as expeditiously as possible and in any case within eight weeks of the petitioner's appearance before the respondent no.2. 4.
The petitioner shall appear before the respondent no.2 on 23.10.2023.

Needless to state that if the authorities find some shortcomings, the petitioner shall be granted time to rectify errors and comply with the shortcomings.
