ORDER:- 1.

Heard learned Counsel for the applicant - wife. The respondent husband, though served with notice, but remained absent.

The applicant - wife is seeking transfer of Petition No.A-875/2021 pending in the Family Court, Mumbai at Bandra, filed by respondent - husband for getting divorce, to the Family Court, Ahmednagar.

According to the applicant-wife, she is not having any independent source of income and having one daughter and one son to look after. Further, the distance between Ahmednagar and Mumbai is of 300 kms. Moreover, she has also filed proceedings under Section 125 of Cr.P.C. in Family Court, Ahmednagar wherein the respondent - husband has

(2) 968 MCA-301.2022.odt already appeared. Therefore considering the convenience of applicant - wife, the following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) Petition No. A-875/2021 pending in the Family Court, Mumbai at Bandra is transferred to the Family Court, Ahmednagar for it's disposal according to law.

(iii) The respondent is directed to appear before Family Court, Ahmednagar on or before 15th March 2023.

(iv) The application is disposed of accordingly.
