This is the second Application for Suspension of sentence and Bail.

It is submitted by the learned Advocate for the Applicant/Appellant that the Applicant, being a lady and behind the bars for more than eighteen (18) months, and there being no possibility of the Appeal being heard finally in the near future, the Application be allowed. He further submits that, during the trial, the Applicant was on bail.

It is submitted by the learned APP for the State that the Appeal itself can be heard.

There is no dispute that the earlier Application of the Applicant bearing No. 3292 of 2024 came to be rejected on merits by this Court by order dated 05.09.2024. Thereafter, on 27.09.2024, the Hon'ble Apex Court also rejected the Application for Suspension of Sentence. It is more than a year that the Appeal could not be heard finally. The Applicant is a lady and she is behind the bars for a period of little over eighteen (18) months and that there is no likelihood of Appeal to be taken up for final hearing in the near future. Hence, I proceed to pass the following order: -

ORDER

[i] The Application is allowed.

[ii] The sentence imposed upon the Applicant by the learned Additional Sessions Judge, Udgir, District Latur, vide the impugned Judgment and Order dated 30.07.2024 passed in Sessions Case No. 02/2021, is hereby suspended till the final decision of the Appeal. The Applicant be released on bail on his furnishing personal bond of Rs. 30,000/- [Rupees Thirty Thousand], with one or two sureties in the like amount. [iii] Bail before the Trial Court.
