Advocate Mr. H. B. Nandagavale, holding for Mr. S. V. Gundre, learned advocate for respondents-claimants, on instructions, ready to accept the interest under Section 28 of the Land Acquisition Act, 1894 from the date of award passed by the Special Land Acquisition Officer instead of from the date of issuance of notification under Section 4 of the Act. Statement is accepted subject to submission of undertaking to that effect by the respondents - original claimants. The amount shall be deposited within a period of six months in this Court. If it is deposited in the Court, same shall be permitted to be withdrawn by the respondents-original claimants. 3.

The officers present on behalf of State and Acquiring Body undertake to make the payment as per compromise within a period of six months from the date of order. The claimants are at liberty to withdraw the same. The undertaking is accepted and appeals are disposed of accordingly. No order as to costs. 4.

The court fee if any paid in the respective appeals, shall be

In case of amount already deposited in this Court, the same shall be permitted to withdraw by the claimants and the said amount shall be adjusted in the final decreetal amount.
