This is an application seeking condonation of delay caused in presenting the instant appeal by the applicant / appellant Insurance Company. The delay of 87 days has been caused. Learned Counsel appearing for the appellant / applicant submitted that in complying with the official formalities, some time has been consumed and, as such, delay has been caused in preferring the appeal. Learned Counsel submitted that the delay caused is unintentional and not deliberate. Learned Counsel for the original claimants has strongly opposed for condoning the delay.

After having heard the learned Counsel for the parties, it appears to me that the delay is not of longer period and, moreover, the reasons which are stated in the application for occurrence of the said delay are just and sufficient. I am, therefore, inclined to allow the present application. AGP/-
