This is an Application for Anticipatory Bail in Crime No.233/2024, registered on 07/08/2025 with Basamba Police Station, District Hingoli, for the offence punishable under Sections 189(2), 126(2), 118(1), 115(2), 352, 351(2) and 351(3) of the Bharatiya Nyaya Sanhita Act, 2023.

Heard the learned Advocate for the Applicant and the learned APP for the Respondent - State.

It is the case of Prosecution that, on 06/08/2024 at 19:00 hours i.e. 07:00 p.m., the Applicant along with FIR named Accused assaulted the Informant and his brother on account of the previous day quarrel between the Accused No.2 and the Informant. The injured were assaulted by iron rod and wooden stick.

The Applicant is admittedly named in the FIR. The role attributed to the Applicant is that of assault by a wooden stick. The other Co-accused are released on Bail. The Applicant is working as the Constable with the State Reserve Police Force [SRPF]. The Investigating OfÏcer, by a written communication dated 08/08/2024, inquired as to whether the Applicant was on duty on the day of the incident. The ofÏce of the Applicant informed the concerned Police Station that, the Applicant was on his duty from 17:00 hours on 06/08/2024 till 17:00 hours on 07/08/2024. This prima facie supports the contention of learned Advocate for the Applicant that, the Applicant was not present on the spot of incident. The Applicant was protected by an interim order dated 24/10/2024. It is nobody's case that, the Applicant misused the liberty. In this view of the matter, I am inclined to confirm the said interim protection. Hence the following order:

ORDER

[I] Interim Order granted by this Court dated 24/10/2024 is confirmed.
