PER COURT :- I do not find any substance in this writ petition. Though, the Hindu Marriage Petition preferred by the petitioner seeking Restitution of Conjugal Rights came to be dismissed in default, the learned 4th Jt. Civil Judge S.D., Latur has maintained the order of interim maintenance passed during the pendency of the said Hindu Marriage Petition bearing HMP No.142/2012. I do not find any fault in the impugned order passed by the court below. Even if the petition seeking decree of Restitution of Conjugal Rights came to be dismissed in default, the earlier order directing present petitioner to pay the interim maintenance to the wife would remain as it is and, the petitioner is liable to pay the interim maintenance as directed by the Court till the order of dismissal of the Hindu Marriage Petition in default. Writ Petition is accordingly dismissed. No costs. ( V.K. JADHAV, J. ) ...
