Heard learned Counsel for applicants and learned Counsel for respondent No.2. Learned Counsel for the applicants submits that, respondent No.1 Dattatraya Shankarrao Bhosale is died during pendency of appeal. Hence, his heirs and legal representatives are necessary to be taken on record, by condoning the delay for fling this application.

Learned Counsel further submits that, deceased has Pooja K.

{2} 951-CA-1424-2022 fled appeal before this Court and in the said appeal his legal heirs are already taken on record. He is requested to bring legal heirs of respondent in that matter but learned Counsel inform him that, he had not received instructions from his client hence, requested to allow application and also requested to condone the delay for fling application. 3.

Considering the submissions and reasons mentioned in the application, application is allowed. Delay for fling the application is condoned.
