14.03.2017 ORAL JUDGMENT :- Rule. Rule made returnable forthwith and heard finally by consent of learned Counsel for the petitioners and learned AGP for respondent Nos.2 to 4.

By order commonly passed on 15.10.2016, the Divisional Jt. Registrar, Co-operative Societies, Aurangabad, has rejected the prayer of the petitioners to stay the effect and operation of the order passed by the Dy. Registrar, till final disposal of the appeals. Heard learned Counsel for the petitioners and learned AGP for respondent Nos.2 to 4, who appears by waiving notice on behalf of the respondents. At this stage there is no need to issue notice to respondent No.1.

Considering the stage of appeals pending before the Divisional Jt. Registrar, Aurangabad and the orders passed by the Dy. Registrar, the Divisional Jt. Registrar, Co-operative Societies, Aurangabad, has rejected the prayer of the petitioners to stay the effect and operation of the orders passed by the Dy. Registrar,

( 8 ) till final disposal of the appeals. The learned Counsel for the petitioners submits that all these appeals are kept for final hearing on 29.03.2017 and are likely to be disposed of thereafter shortly. Considering the fact that these appeals are now kept for final disposal, any order passed in these writ petitions would be of only academic nature and therefore at this stage this Court does not find it necessary to make any interference in the impugned orders.

The writ petitions, are disposed of with a direction that all the appeals shall be finally disposed of by respondent No.3 as expeditiously as possible after giving reasonable opportunity of hearing to both the sides. Respondent No.3 shall make endeavour to dispose of these appeals as far as possible within two months after arguments are heard.
