ORDER:

We have heard Shri. Shahaji B. Ghatol Patil, learned counsel for the petitioner and Shri. P. S. Patil, learned Assistant Government Pleader for respondents No. 3 to 5. 2.

Shri. Patil, learned Assistant Government Pleader, on instructions, submits that the Officer had not considered the amendment to the Government Resolution of the year 1979. The Officer would reconsider the claim of the petitioner.

The respondents shall reconsider the claim of the petitioner in view of the Government Resolution of 1979 with relevant amendments dt. 29.11.1979 so also the order of this Court dt.06.10.2016 in Writ Petition No. 9193 of 2015. The respondents assure to reconsider the claim of the petitioner within two months. 4.

The statement made by learned Assistant Government Pleader is accepted.

In view of the fact that, the claim of the petitioner is being reconsidered by the respondents, the impugned communication dt.05.08.2017 shall not subsist.
