The learned counsel submits that the petitioner has submitted the proposal to the Respondent Committee seeking validation of his caste certificate of Khatik (OBC). The same is refused to be accepted by the Committee on the

2 W.P.No.12534/17 ground that the petitioner has not contested the election of Jalna Municipal Council, held in 2016.

We have heard learned Additional Government Pleader.

Even if an individual approaches the Committee seeking validation of his caste certificate, the Committee is bound to accept the said proposal (if the same is in proper format) and it can not refuse to accept the same only on the ground that the same is not through any institution.

In case the petitioner files proposal with the Respondent No.2 Committee seeking verification of his caste claim in a proper format, the Respondent No.2 Committee shall not refuse to accept the said proposal and shall decide the same on its merits in accordance with law.

The Writ Petition is accordingly
