The learned Assistant Government Pleader states that, he has received communication from the respondents stating that the tender process, conditions of which are under challenge in the present writ petition has already been cancelled and retendering process is to be conducted. 2.

We have heard Mr. Thombre, the learned counsel for the petitioner.

In view of the statement made by the learned A. G. P. that tenders in question in the present writ petition have been

2 wp 11112.15 cancelled and it has been directed to call re-tender, the challenge made in the petition does not survive. The writ petition as such is disposed of. No costs.

In case re-tender is issued and the petitioner is aggrieved by any condition, it would be open for the petitioner to assail the same.
