A TATA Motors Pickup Van has been seized as having been found involved in commission of the offence punishable under Sections 417, 420, 328, 188, 269, 270, 273, 482, 485, 486 and 488 of the Indian Penal Code. respondent No.2 herein. Before the Court of learned Judicial Magistrate, First Class, the respondent No.2 gave consent for release of the vehicle in favour of the petitioner. The vehicle is of day-to-day use. No useful purpose could be served by keeping it idle. In the fitness of things, the Criminal Writ Petition is allowed in terms of prayer clauses A, B and C.
