Mr. Phule, holding for Mr. Salgare, learned counsel appearing on behalf of respondents No. 3 to 5 submits that original first appeal No. 665 of 2008 has already been transferred to the concerned District Court on account of pecuniary jurisdiction for its adjudication on merits and as present contempt petition also arising out of the said first appeal, hence, present contempt petition is required to be transferred to the same court for it's adjudication on merit. 2.

Learned counsel for respondent No. 1 has no objection for the same.

In view of the aforesaid submission, there is no impediment to transfer the present contempt petition for it's adjudication on merit along with original first appeal No. 665 of 2008. 4.

Registry to take requisite steps for transfer of present contempt petition for adjudication on merit along with original first appeal No. 665 of 2008 already transferred to the concerned District Court. [ K. K. SONAWANE ] JUDGE MTK.
