The petitioners claim that their property has been affected by a public road without undertaking any acquisition proceeding. 3.

The learned advocate for the petitioner tenders across the bar a copy of the communication addressed by the Executive Engineer of Zilla Parishad Nandurbar to the District Collector Nandurbar dated 28.11.2022 requesting to start acquisition process. It is taken on record and marked as 'X' for the purpose of identification. He submits that in view of such supervening event, the Collector may be directed to take appropriate decision. 4.

The learned Government Pleader after going through this copy of communication submits that already a proposal must have been received by the Collector and he would take appropriate decision in accordance with law.
