The Civil Application is filed for modification of the order dated 04.06.2019, wherein the petitioner was directed to deposit Rs. 1,50,000/-.

The learned advocate for the applicant points out that the respondent / Authority has imposed fine of Rs. 1,18,390/- on the petitioner and this Court in an order under review directed petitioner to deposit Rs. 1,50,000/- which is improper.

We have heard the learned Additional Government Pleader. 4.

The document on record shows imposition of penalty on the

928CA12767.19.odt applicant of Rs. 1,18,390/-. In view of that, it would not be appropriate to direct petitioner to deposit Rs. 1,50,000/-. 5.

In light of the above, the order dated 04.06.2019, is modified. Para 3 (ii) of the order dated 04.06.2019, shall stand recalled. It is further clarified that the deposit is subject to the decision in the appeal that would be filed by the petitioner.
