This application has been moved for quashment of F.I.R. The applicant is stated to have been Vice President of the Company. The Investigating Officer is reported to have found the applicant in Chennai on the day, on which the crime took place in Osmanabad District. The investigating Officer had even filed 'A' summery report. The learned Magistrate has not accepted the same.

The informant has opposed for acceptance of the said report. The informant is now before us. He gives consent to allow this application. Since the investigation has been directed to be made and the applicant not named in the F.I.R., this Court is not inclined to allow this application.

Suffice it to say that Investigating Officer appears to have given the applicant clean chit as the applicant was found in Chennai, whereas the offence took place in Osmanabad District. The informant accepts the same. With these observations, the writ petition is disposed of. 3.
