This is yet another instance as to how the public authorities function unmindful on the request of an individual or an establishment. When the petitioner is seeking renewal of the license under the Juvenile Justice (Care and Protection of Children) Act 2015, having already in possession of similar license under the predecessor Act of 2006, by the impugned order the request has been rejected only on the ground that there are several short comings in the proposal, which were communicated to the petitioner purportedly by communication (Exhibit - G) dated 28 July 2023 and stated to have been even responded by it on 28 September 2023. If it is merely a matter of certain

2 wp 12007.24 shortcomings, we strongly deprecate the approach of the respondents, in rejecting the proposal/request. It could have waited for a longer duration seeking compliance. 3.

Be that as it may, we allow the petition, quash and set aside the impugned order to the extent of the petitioner and call upon respondents to reconsider petitioner's proposal in the light of subsequent compliance made vide communication dated 28 September 2023, on its own merits.
