ORDER :- The challenge in this petition is to the order dated 4 May, 2021, passed by the respondent - Chief Officer, Municipal Council, Jalna, placing the petitioner under suspension in contemplation of departmental enquiry.

Learned counsel for the petitioner points out that two other employees namely Lahu Chavan and Baban Gavai who were also placed under suspension, on the same date, in view of an incident of fire in the Tax Department of the Municipal Council on 28 April, 2021, their suspension has been revoked by an order dated 25 January, 2022. A copy of the order is placed on record and is marked as

{2} 6WP14192.21.odt exhibit 'X' for identification. A perusal of the said order shows that the order of suspension has been revoked subject to the departmental enquiry, if any. Learned counsel for the petitioner submits that the petitioner has been singled out only on account of the fact that the present petition is pending.

Learned counsel for the respondent - Municipal Council, on instructions, states that a similar order revoking the suspension of the petitioner shall be passed by the Chief Officer within one week from today. The statement so made is accepted.

In such circumstances, the petition is disposed of subject to the statement made on behalf of respondent as aforesaid. No costs. SANDIPKUMAR C. MORE, J.
