Heard learned Counsel for the applicant - wife. The respondent - husband, though served but remained absent. 2.

The applicant - wife is seeking transfer of Hindu Marriage Petition No. 579 of 2019 pending in the Court of C.J.S.D. Baramati, Dist. Pune filed by respondent - husband for getting divorce, to the court of C.J.S.D. Paranda, Dist. Osmanabad.

According to the applicant - wife, she is not having any independent source of income and at present she is maintaining one minor daughter without any financial help from the respondent - husband. Moreover, she has also filed 1/2 Pooja Kale

979-MCA-310-2022 three proceedings at Paranda wherein the respondent - husband has already appeared.

Thus, considering the fact that, respondent - husband is already attending the dates at Paranda, Dist. Osmanabad following order is passed :

ORDER

(i) The application is hereby allowed.

(ii) Hindu Marriage Petition No. 579 of 2019 pending in the Court of C.J.S.D. Baramati, Dist. Pune is transferred to the Court of C.J.S.D. Paranda, Dist. Osmanabad for disposal according to law.

(iii) The respondent - husband is directed to appear before the court of C.J.S.D. Paranda, Dist. Osmanabad on or before 15th April, 2023.
