The petitioners are the primary societies who are approaching this Court through their respective Chairman being anxious of the fact that the elections for the Agriculture Produce Market Committee, Mahur would be conducted, but because of the elections of the societies having been concluded after the cut off date, their names may not be included in the voters list.

The learned advocate Mr. Kadam for the respondent Nos. 2, 3 and 4, on written instructions from the District Co-operative Election Officer-cumDistrict Deputy Registrar Co-operative Societies Nanded submits that as of now the provisional voters list for holding the elections of APMC Mahur is still to be published. First five societies (petitioner Nos. 1 to 5) would be eligible for inclusion of their names in the voters list if and when the programme is notified.

He also submits that depending upon the cut-off date to be notified, if the rest of the petitioners become eligible, even their names would be included in the provisional voters list.

The learned advocate for the petitioners, in view of such statements being made by Mr. Kadam, on instructions, seeks leave to withdraw the Writ Petition.

Leave is granted.

The Writ Petition is dismissed as withdrawn.
