Heard the learned advocate for the petitioner as well as the learned Government Pleader.

The petitioner is seeking refund of the amount deposited by him pursuant to the allotment of contract for excavation of sand from the riverbed.

Learned advocate for the petitioner submits that he has moved an application with the Collector, Parbhani but since he was not deciding it, the petitioner had to approach the office of the Divisional Commissioner and the Divisional Commissioner, by his letter dated 18.09.2022 addressed to the Collector, Parbhani has once again requested to decide the petitioner's claim.

We dispose of the writ petition by directing respondent No.3Collector, Parbhani to take appropriate decision on the petitioner' s application as is directed by the Divisional Commissioner, as early as possible and in any event, within six weeks from today.
