This is the Application for condonation of 3502 days delay in preferring the First Appeal against the Judgment and Award dated 08.12.2009 passed by the learned Reference Court in LAR No.1023/1998.

Pursuant to notice issued on the Application, the learned AGP appears for Respondent No.1 / State and the learned Advocate appears for Respondent No.2.

The learned Advocate for the Applicant submits that the Applicant is a poor farmer and his land has been acquired and due to financial constraint, he could not approach this Court within the stipulated period.

The Application is opposed by the learned AGP for Respondent No.1 / State and learned Advocate for Respondent No.2. 5.

Perusal of the Application shows that the grounds in support of delay are mentioned in paragraph no.3. By considering the grounds in the Application, the Application is allowed in terms of prayer clause ' B'

subject to condition that the Applicant will not be entitled for the statutory benefits and the interest for the said delayed period. Appeal be registered in accordance with law. Civil Application stands disposed of accordingly.
