For the reasons stated in the application, the delay is sought to be condoned which request is vehemently opposed by Mr Bora, learned Counsel for respondent No.1.

In the interest of justice, delay of 252 days in filing the second appeal is condoned subject to payment of costs of Rs.1,500/- (Rs.One thousand five hundred) to be paid to High Court Bar Association's Library within a period of two weeks from today. Payment of costs is condition precedent.
