PER COURT :- 1) Heard. The petitioner is praying for issuance of directions to the respondents to issue work order in his favour since he was found successful in the tender process initiated on 23.1.2014.

2) Counsel appearing for the respondents has placed on record office note dated 7.10.2014 submitted by the Executive Engineer (Civil),TPS Parli Vaijnath as well as letter dated 23rd July 2014, issued by Chief Engineer(C) GEN-III MSPGCL, Mumbai, thereby informing that the tender process is being cancelled on account of funds crisis. The same are taken on record and marked as "X" for identification.

3) Since the tender process is being withdrawn and that the petitioner does not have any vested right to claim award of tender work, the petition does not deserve favourable consideration and the same stands rejected.
