Learned counsel for the petitioners in all these petitions submits that the petitioners-original defendants have also filed counter claim in the suits instituted by the respondents. These writ petitions have been preferred against the order passed below Exh.5 by the trial court in three different suits. Learned counsel, on instructions, submits that the parties have closed their evidence and the trial court has posted the suits for final hearing. 2.

In view of above, at this stage, no purpose would be served in deciding the writ petitions wherein the order passed below Exh.5 are under challenge. Writ petitions are accordingly disposed of.

It is made clear that this Court has not touched to the merits of the case. All points are kept open. The trial court may dispose of the suits on its own merits on the basis of oral and documentary evidence adduced by the respective parties.
