We have heard Mr. Sagar Killarikar, learned Counsel for the petitioners, the learned A.G.P. and Mr. Hon, learned Senior Advocate for the respondent / institution.

The only directions sought under the present matter is that the management and the school authorities be directed to prepare the common seniority list and submit the same to the approval of the respondents.

Mr. Hon, learned Senior Advocate for the respondent contends that the Society runs many schools some are on unaided and some are on aided.

2 wp 12830.2019 There could not be a common seniority list of both.

In that case, the respondent is bound to prepare the common seniority list of all the employees working on the aided post and a separate seniority list with regard to the employees working on unaided post.

Mr. Hon, the learned Senior Advocate submits that the management has prepared such seniority list separately.

The management shall submit the said seniority list to the Education Officer preferably within four (04) weeks. The petitioners may raise their objection. The concerned Education Officer shall take decision upon it on it's own merits, after hearing all parties concerned, expeditiously and preferably within a period of four (04) months from the date of objection.

Writ Petition is accordingly disposed of. No costs.
