We have heard the learned advocate for the petitioner for some time. After recollecting that in all probabilities, we had dealt with his matter at some earlier point of time, we had asked the office as well as the learned advocate for the petitioner to verify the fact as to if the petitioner had already approached this Court and had attempted to raise the issue regarding self same tender process.

In the second session, the learned advocate for the petitioner fairly concedes that indeed the petitioner had kept her in dark. Already he had filed a writ petition, which was dismissed by this Court on 14 September 2023.

In Writ Petition No 11339 of 2023 by order dated 14 September 2023 after hearing the learned advocate for the petitioner in respect of similar objection to the self same tender process, we had dismissed it and still the petitioner by engaging another lawyer seems to have made an attempt, which according to us is an attempted fraud. This is a gross abuse of process of law. We dismiss the petition by imposing cost of Rs. 25,000/- (Rs. Twenty Five thousands only), which he shall deposit in this Court within a period of two (02) weeks from today, else copy of order be sent to the Collector, Aurangabad for making recovery as arrears of land revenue.
