On 08/01/2018, I had passed the following order :- "1. The petitioner is aggrieved by the decision of the District Selection Promotion Committee dated 4.2.2016 and the order of the Divisional Commissioner, Aurangabad dated 27.12.2016. She prays for promotion to the post of "Avval Karkun".

2. Issue notice before admission to the respondents, returnable on 7.2.2018. Reply, if any, shall be filed by the respondents on/or before 2.2.2018.

3. Learned AGP waives service for respondents 1 to 3." 2.

The office of the District Collector, Parbhani has entered an affidavit in reply through Ramdas Kondiba Kolgane, who is working as a "Nayab Tahsildar".

At the outset, I record my displeasure considering that the District Collector, Parbhani is said to have authorized a Nayab Tahsildar to file an affidavit in reply in the High Court, when he is the lowest Revenue Authority in the Revenue Hierarchy. The learned Registrar (Judicial) of this Court shall place a copy of this order before the District Collector, Parbhani so as to enlighten him that the affidavit in reply on behalf of the Collector should be filed by an Officer who could exercise the delegated powers of the Collector. 4.

At this juncture, the learned advocate for the petitioner submits on instructions that the petitioner desires to withdraw this petition.
