Learned Counsel for the applicants submits that due to his own diffculty, he could not attend hearing of the case and as such his client should not suffer for that. The learned Counsel submits that he is from outstation and on the date of hearing, while proceeding towards Court, he met with an accident.

In view of the above submission and for the reasons stated in the application, application is allowed in terms of prayer clause "(i)", subject to cost of Rs.100/- (Rs.
