This motion is moved for modification of order dated 12.12.2024 passed in above Civil Application with effect from date of the order.

Learned counsel for the applicant made statement that he has already intimated about this motion to the counsel for respondent No.1 who has shown his inability to remain present before this Court as he is out of station.

Learned Counsel for applicant submit that in view of the order passed in Civil Application No. 12366/2021, Writ Petition No. 9785/2018 ought to have been disposed of. He further seeks clarification to the effect that the amount of cost of Rs. 25,000/- to be paid to the respondent is inclusive of the cost granted earlier to be deposited before the trial Court on 29.08.2018.

Perusal of the record indicates that while passing order on Civil Application, above points ought to have been recorded in the order. It seems inadvertently the same were not included. Hence, following paragraphs be included in order dated 12.12.2024 in application. "5.

The above cost is inclusive of the cost granted earlier to be deposited before the trial Court on 29.08.2018. 6.

In view of the order passed in Civil Application No. 12366/2021, Writ Petition No. 9785/2018 stands disposed of."
