The learned counsel for the petitioners submits that mutation entry made in favour of the appellant has been cancelled by the Sub Divisional Officer by order dated 4.9.2025. Thereafter, the petitioners filed appeal before the Additional Collector and during the pendency of the appeal, interim application for stay is filed, which has been rejected by the learned Additional Collector vide order dated 3.10.2025. Hence, the present writ petition is filed.

The learned AGP points out that against the impugned order revision is maintainable before the State under section 257 of the M.L.R. Code. 3.

Considering the submission of the learned AGP, the learned counsel for the petitioner seeks leave of this court to withdraw the present writ petition with liberty to approach the State in a revision to challenge the impugned order dated 3.10.2025 passed by the Additional Collector. The learned counsel submits that since the relief is refused on interim application, there is urgency in the matter.

In view of the above, the writ petition is dismissed with liberty to the

WP 12750/25 petitioner to challenge the impugned order before the concerned State authorities. If such a revision is filed before the concerned authority, the concerned authority to decide the same as expeditiously as possible considering the challenge is to the refusal of interim relief in pending proceedings.
