This petition is questioning the order dated 13.09.2023 passed below Exhibit-48 in Regular Civil Suit No.102/2022 filed by the petitioner. Considering the nature of the application (Exhibit-48) and the impugned order, the learned Counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file comprehensive application before the trial Court covering all aspects of the matter for appointment of Receiver and for further directions. It is also urged that suit needs to be expedited considering the urgency in the matter.

The writ petition is disposed of as withdrawn with liberty to the petitioner to file comprehensive application seeking appointment of Receiver or any further directions as permissible in law.

It is expected that the learned Judge shall consider the application to be filed on its merits without being influenced by the earlier orders. 4.

The learned trial Judge shall make an endeavour to decide the suit finally within a period of nine months.
