This is the Application by the Claimant for condonation of 2417 days delay in preferring the Appeal against the Judgment and Award dated 28.11.2012 passed by 2nd Jt. Civil Judge, Senior Division, Aurangabad in LAR No.307/1999 with connected matters. 2.

It is submitted by the learned Advocate for the Applicant that sufficient reasons are shown in the Application which prevented the Applicant from preferring the Appeal within the stipulated time. He submits that this Court in the connected matters arising out of the same acquisition proceedings i.e. in Civil Application Nos.6088 of 2022, 5560 of 2020, 5561 of 2020, 5585 of 2020 passed Orders dated 30.08.2024 and 07.07.2023, respectively, has condoned the delay. He submits that the Application be allowed.

The Application is opposed by the learned AGP. 4.

After hearing both the sides and on going through the aforesaid orders, by which the Applications for condonation of delay of similarly situated claimants are allowed and for the reasons mentioned in paragraph nos.3 and 4 of the Application, the Application is allowed in terms of prayer clause 'B'. The Applicant shall not be entitled for the statutory benefits and interest for the aforesaid delayed period. Copy of this order be kept in the order sheet of the Appeal memo. Application stands disposed off accordingly.
