By this Writ Petition, the petitioner is seeking direction to decide his caste claim of belonging to Koli Malhar Scheduled Tribe which is pending for consideration before the Caste Scrutiny Committee since 04.02.2020.

The learned counsel for the petitioner submits that the petitioner is in service and there is every apprehension that his services would be terminated on the count of non submission of caste validity certificate. 4.

Considering the same, we direct the Respondent No.2/Caste Scrutiny Committee to decide the caste claim of the petitioner within a period of six months from today.

Till the caste claim of the petitioner is decided by the Respondent No.2/ Caste Scrutiny Committee, the Respondent Nos. 3 and 4/

2 58.doc Employers shall not take any coercive action against the Petitioner. 6.

We make it clear that the protection granted by this Court shall operate only till the caste claim is decided by the Respondent No.2/Caste Scrutiny Committee.

The Writ Petition is allowed in above terms.
