The petitioner who has been serving on the post of Dean in Government College of Art and Design, Chhatrapati Sambhajinagar and claims to be the second senior-most in the seniority list, is questioning the sustainability of the order, whereby respondent no. 4 who is from the cadre of Lecturer has been given additional charge of the post of Director. Having failed to have any ad-interim relief in the original application filed in the Maharashtra Administrative Tribunal, he is challenging the order. 2.
Considering the nature of the dispute, when the tribunal has expressly mentioned in paragraph no. 5 that it would decide the application finally at once and even would not issue any separate notice for final disposal, it would be appropriate that the petitioner persuades the tribunal to decide the original application finally at the earliest.

Granting any ad-interim relief at this stage would create a void and there would be no one to handle the additional charge of the post of Director.
