Heard learned Counsel for the petitioner. The petitioner had moved an application to the Collector on 26.09.2024 for transfer of revision pending before the Sub Divisional Officer, Pachora. Wild allegations have been levelled against the Sub Divisional officer. Hence, he sought transfer of the revision. 2.

Issue notice to the respondents. Learned A.G.P. waives service of notice for both the respondents. He has submitted few papers indicating that the application of the petitioner is under consideration. The Collector has called factual explanation from the Sub Divisional Officer, Pachora. The explanation has been submitted. Now it is upto the Collector to take an appropriate decision.

We are aware of the fact that the Collector and all other revenue officers were busy with the elections. Now the elections are over. We hope the Collector would get time to pay attention towards such matters and timely decision. 4.

The learned A.G.P. would also point out that the revision before the Sub Divisional Officer (respondent No.2) was time bound as per the order of this Court and judgment should be delivered on or before 20.12.2024. He expressed apprehension that in the scenario, time scheduled by this Court may be violated and the petitioner may file a contempt proceeding. In the supervening circumstances, we pass the following order.

ORDER

(i) The Writ Petition is partly allowed.

(ii) The respondent-Collector is directed to decide the transfer application of the petitioner within one week.

If the contingency arises and Sub Divisional Officer (respondent No.2) faces difficulty in deciding the appeal as per the order of this Court passed in Writ Petition No.4168 of 2024, time is extended for further one month.
