After hearing the learned Advocate for the applicant and the learned AGP on behalf of the State, I proposed to the parties that they may address the Court on the second appeal itself, so that the same would be decided on its merits today, as the issue involved is only as regards an amount of Rs.983/- towards the outstanding remuneration of the applicant.

Yet, both the parties have sought some time.

This application is filed for seeking restoration of the second khs/March 2015/12991-14 (d)

appeal by condoning 39 days delay in the light of the order passed by this Court on 01/10/2013.

For the reasons set out in the application, the same is allowed. The delay of 39 days is condoned. Private paper book shall be filed within the course of the day since it is stated that the same is ready to be filed.

As such, the Second Appeal no.19/2012 shall stand restored after filing of the private paper book.
