APPELLATE SIDE, BENCH AT AURANGABAD 8 MISC.CIVIL APPLICATION NO. 173 OF 2015 SAU. ARUNA JITENDRA AMBEKAR

VERSUS

JITENDRA RAMLINGAPPA AMBEKAR ...

Advocate for Applicant : Deshmukh B.G.

...

CORAM : T.V. NALAWADE, J.

DATED : 14th March, 2016.

ORDER :

1.

During arguments, the learned counsel for applicant, wife submitted that the wife had filed proceeding for divorce and said proceeding came to be allowed on 11.2.2016. Nothing is known to the wife whether the said decision is challenged by the husband. She wants transfer of proceeding u/s. 9 of Hindu Marriage Act filed by the husband for restitution of conjugal rights which is presently pending before Jalgaon Court to the Court of Nanded. If the marriage is dissolved, proceeding which is filed for restitution of conjugal rights becomes infructuous. So, present application filed for transfer of that matter cannot be allowed. The application is disposed of as infructuous. [ T.V. NALAWADE, J. ] ssc/
