It is an application moved by the appellant to bring on record legal heirs of respondent No. 7 with prayer for condonation of delay and setting aside the abatement order.

Heard Mr. Deshpande learned Advocate for appellant and Mr. Dargad learned Advocate holding for Mr. S.G.Chapalgaonkar for the respondents/the original claimants.

There is delay of 716 days in filing the application so as to bring on record the legal heirs. In

2 916 CA-13933-18 order to decide the appeal on merits, it is necessary to condone the delay by allowing this application. I proceed to pass following order;

ORDER

01.

The application stands allowed in terms of prayer clause (B) to (D).

02.

The appellant to carry out the necessary amendment in array of title.

03.

After making necessary changes, issue notice to the legal heirs of respondent No. 7 returnable 11.01.2022.
